Terms of Use

1. The Service

PromptFy provides teleprompter, recording, script, subtitle, editing, voice, dubbing, translation, and AI-assisted creation tools. Features may vary by device, country, app version, plan, credits, availability, and third-party provider capacity.

2. Eligibility and accounts

You must be at least 13 years old and legally able to agree to these Terms. PromptFy may create an anonymous account when you first use the app. You are responsible for your device, account access, and activity performed through your account.

3. Subscriptions, trials, and credits

Paid plans and credit packs are purchased through the Apple App Store. Prices, taxes, trials, billing periods, renewal dates, and refund eligibility are presented by Apple at purchase. Subscriptions renew automatically unless canceled through your Apple ID before renewal. Credits are consumable, may expire where disclosed, have no cash value, and are non-refundable except where required by law. Deleting your PromptFy account does not cancel your Apple subscription.

4. Your content

You retain ownership of scripts, recordings, media, voices, and other content you provide or create. You grant us a worldwide, limited, non-exclusive license to host, copy, transmit, process, adapt, and create technical derivatives of that content only as needed to provide, secure, support, and improve the Service. You represent that you have all rights and permissions needed for content you upload or share.

5. Voice cloning and consent

You may clone or synthesize only your own voice or a voice for which you have explicit authorization. You must not impersonate, deceive, defraud, harass, or violate another person's privacy, publicity, intellectual-property, or other rights. We may suspend access to voice features or remove related content when misuse is suspected.

6. AI outputs

AI-generated scripts, translations, tags, voices, and media may be incomplete, inaccurate, offensive, or unsuitable. Outputs are not professional, legal, medical, or financial advice. You are responsible for reviewing outputs, verifying facts, obtaining permissions, disclosing synthetic content where required, and deciding whether and how to publish or use them.

7. Acceptable use

• Do not violate laws or the rights of others, including copyright, privacy, publicity, and data-protection rights.
• Do not create or distribute fraudulent, deceptive, exploitative, abusive, hateful, sexually exploitative, or otherwise unlawful content.
• Do not clone a voice, record a person, or upload media without the authorization required by law.
• Do not probe, disrupt, overload, reverse engineer, bypass security, manipulate quotas, automate abusive requests, or interfere with the Service.
• Do not resell, sublicense, or provide the Service as a competing service without written authorization.

8. Third-party services

The Service relies on Apple, Google, Amplitude, ElevenLabs, TikTok, Railway, Cloudflare, and other third parties. Their services and terms may apply separately. We are not responsible for third-party platforms, content, outages, policy changes, or actions outside our control.

9. Intellectual property

PromptFy, its software, visual identity, designs, documentation, and technology are owned by or licensed to IVLS Tech. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose in accordance with these Terms and applicable App Store usage rules.

10. Suspension and termination

You may stop using the Service and delete your account at any time. We may restrict or terminate access when you violate these Terms, create risk or legal exposure, fail to pay applicable charges, abuse the Service, or when required by law. Provisions that by their nature should survive termination will survive.

11. Availability and changes

We may add, modify, suspend, limit, or discontinue features and may update usage limits or plan benefits. We aim to provide a reliable Service but do not guarantee uninterrupted availability, preservation of every local or cloud file, or compatibility with every device or third-party platform.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. These exclusions do not limit mandatory consumer rights that cannot legally be waived.

13. Limitation of liability

To the maximum extent permitted by law, IVLS Tech will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Apple-specific terms

These Terms are between you and IVLS Tech, not Apple. IVLS Tech, not Apple, is responsible for the Service, support, and claims relating to it. Apple and its subsidiaries are third-party beneficiaries of the license terms applicable to the iOS app. Your use must comply with the App Store Usage Rules and applicable Apple Media Services terms.

15. Governing law and changes

These Terms are governed by the laws of the Federative Republic of Brazil, without limiting mandatory protections or jurisdiction available under applicable consumer law. We may update these Terms and will indicate the effective date. Continued use after an update takes effect constitutes acceptance where permitted by law.
